Pursuant to CCP § 2025.330(b), a Court Reporter is not required. The deposition must be conducted under the supervision of an officer authorized to administer oaths (e.g., notary public), pursuant to CCP §§ 2025.320(a).

Under CCP 2093(a) a notary public has the power to administer oaths and affirmations and therefore can be a deposition officer.

The deposition officer administering the oath (e.g., notary public) is responsible for “supervising” the proceedings and remaining present during the entire proceedings.

  California Code of Civil Procedure Section 2025.340 (m) states: “A party intending to offer an audio or video recording of a deposition in evidence under Section 2025.620 shall notify the court and all parties in writing of that intent and of the parts of the deposition to be offered….

The original audio or video record of the deposition shall be preserved unaltered. If no stenographic record of the deposition testimony has previously been made, the party offering an audio or video recording of that testimony under Section 2025.620 shall accompany that offer with a stenographic transcript prepared from that recording."
